HC questions govt inaction

The High Court yesterday questioned the legality of the government's action of not extending retirement age by two years for freedom fighter teachers of non-governmental educational institutions enjoying monthly payment order (MPO) facilities.
In response to a writ petition, the HC issued a rule upon the government to explain in two weeks why its action of not increasing the retirement age of such teachers by two years should not be declared illegal.
According to the petition, the government on December 31, 2009 issued a gazette notification increasing the retirement age of freedom fighter teachers by two years, but it has not implemented the decision.
In yesterday's rule, the court also asked the government to explain why it should not be directed to take effective measures to increase the retirement age of those teachers.
The HC bench of Justice Hasan Foez Siddique and Justice Mustafa Zaman Islam came up with the rule after hearing the writ petition filed by Md Abu Yusuf, headmaster of Pitambarpur High School at Sonaimuri Upazila, Noakhali.
Yusuf recently filed the petition with the HC challenging the government's action of not increasing the retirement age of freedom fighter teachers of non-governmental educational institutions as per the 2009 gazette.
The petitioner prayed to the court to direct the government authorities to implement the decision.
Mahbub Uddin Khokon appeared for the petitioner.
