Kushtia SP’s behaviour with judicial magistrate a severe attack on judiciary: HC

The High Court today observed that the behaviour of the superintendent of Kushtia police with Judicial Magistrate Md Mohsin Hasan was not only a serious contempt of court but also tarnished the image of the judiciary.

"The action of Superintendent of Police of Kushtia SM Tanvir Arafath cannot be taken lightly as he has not only committed serious contempt of court but has also tarnished the image of the judiciary as a whole with contemptuous remarks, behaviour and attitude," the HC said in a suo moto (voluntary) order.

The HC bench of Justice Mamnoon Rahman and Justice Khizir Hayat issued the suo moto order following a newspaper report on the misbehaviour of SP Tanvir Arafath with senior judicial magistrate Md Mohsin Hasan during Bheramara municipality elections on January 16.

"Such behaviour of the said superintendent of police, Kushtia, is a severe attack on the administration of justice and ultimately the entire judiciary," the HC said in the order.

At the same time, the HC bench summoned SP Tanvir Arafath directing him to appear before this court on January 25 for misbehaving with judicial magistrate Mohsin Hasan.

The bench asked SP Tanvir Arafath to appear in person to place his explanation on the allegation of misbehaviour with Mohsin Hasan.

It also issued a rule asking SP Tanvir Arafath to show cause why contempt of court proceedings should not be brought against him and why he should not be punished for misbehavior.

The bench came up with the summons order on a suo moto (voluntary) move following a report published by on a Bangla daily Amader Shomoy.Com today about the incident, Deputy Attorney General Tahirul Islam told The Daily Star.

Judicial Magistrate Mohsin Hasan recently submitted an application to the Election Commission, Supreme Court, home ministry and the inspector general of police to take necessary steps against SP Tanvir Arafat saying that the SP has shown serious misbehavior and uncourteous conduct which is a blatant violation of the Local Government Election Rules, 2010, according to media reports.
