The International Crimes Tribunal-1 yesterday directed the civil surgeon of Dhaka to submit a report on the mental condition of a former BNP lawmaker, an accused of a case filed for allegedly committing crimes during the 1971 Liberation War.

The civil surgeon was asked to submit the report within April 3 after forming a medical board to ascertain the mental condition of Md Rashid Miah, one of the 17 accused in the case.

Yesterday was fixed for passing an order whether it will frame charges against them over their alleged wartime crimes.

But, Abdus Sobhan Tarafder, a defence counsel for Rashid, said his 83-year-old client, now on bail on health grounds, is not physically and mentally fit for trial.

Prosecutor Rana Dasgupta said that it should be determined by a medical board and the tribunal passed the order. Prosecution on March 15, 2016 pressed 12 charges against the 17 from Maheshkhali upazila in Cox's Bazar.

According to the investigators, Rashid and other accused were allegedly involved in killing, torture of women, arson and looting in Maheshkhali in 1971. At least 94 named and many unnamed people were killed in those incidents.

He was a former president of Maheshkhali Convention Muslim League and vice-chairman of the upazila Peace Committee in 1971. In 1978, he became vice-president of Cox's Bazar district BNP and was elected as a lawmaker in 1979.

On Sunday, the same tribunal directed the civil surgeon to submit a report on the mental condition of Muhamed Shahidullah, a former Bangalee army official from Comilla who allegedly worked for Pakistan army during the war, within March 29.
