Certificate case against Ershad dismissed


A Dhaka court yesterday dismissed the certificate case filed against former president HM Ershad for realisation of fine imposed on him in the Janata Tower case.

First Class Magistrate Delwara Begum, also the General Certificate Officer (GCO), passed the order.

In her order, the GCO mentioned that Ershad had earlier served three months and eight days and paid Tk 2,74,35,400. So, the case filed for realisation of the fine from him was dismissed, she added.

On November 23 in 2000, the Appellate Division of the Supreme Court (SC) in a verdict fined Ershad Tk 5,48,70,800, in default he would have to suffer six months in jail.

On September 4, 2001, Judge Kader Newaz of the Second Additional District and Sessions Judge's court filed case with the GCO against Ershad for realisation of Tk 2,74,35,400, as fine imposed on him.

But the case was stayed following an order of the High Court and the stay was vacated on June 15 this year.

Meantime, Delwara Begum expressed her dissatisfaction over a report published in the daily Samakal yesterday titled "Ershad don't have to pay the rest of the fine."

Talking to the The Daily Star, she said that the report was false, fabricated and baseless and wondered how the newspaper got the order and published it one day before the passing of it.

CASE AGAINST RAWSHAN ERSHAD
Another Dhaka court fixed today for decision on the petition filed by Rawshan Ershad against the attachment of 12 kathas of land along with its 14-storied building "Janata Tower" at Karwan Bazar and her residence at Gulshan situated on 33 decimal land.

After hearing both the sides on the petition filed on July 16, Judge Khondaker Hassan Mohammad Firoz of Artharin Adalat-2 passed the order.

The same court on July 12, 2004 directed Rawshan and five others to pay Tk 5,0987,472.65 against the house loan of Tk 3.5 crore taken from the Motijheel branch of Uttara Bank Limited, in 1990.

The court also directed Rawshan and five others to pay the decreed money within 60 days from the day of delivery of the verdict. If they fail to pay, the bank can realise the money from them as per law, the court added.

On January 13 last year, the bank filed a suit claiming Tk 9,99,64279.65 with interest as Rawshan and others failed to pay up within the stipulated time. The bank also gave the schedules of lands on Janata Tower and Rawshan's residence of Gushan area for attachment.
